Is my safety, or my children's safety, at risk right now?

You can seek an emergency protection order and residence order under the Domestic Violence Act 2005, and the police or a Protection Officer can assist immediately. What should I do first if there is no immediate safety risk?

Do not leave the shared household without legal advice first - under Satish Chander Ahuja v. Sneha Ahuja (2020), you have a right to reside there regardless of whose name the property is in. Gather documents quietly rather than announcing your plans, and book a confidential consultation before taking any visible step.

Which documents and items should I secure?

Marriage certificate, your own Aadhaar/PAN/passport, any joint bank and property documents, photographs and proof of gifts/jewellery received as streedhan (which remains your property under Pratibha Rani v. Suraj Kumar, 1985), salary slips if employed, and medical or school records for children. A dated inventory of streedhan items, with photographs, strengthens any later recovery claim.

Will I get maintenance, and how much?

Maintenance is assessed on both spouses' income, assets and the marriage's standard of living, following the detailed-affidavit process set out in Rajnesh v. Neha (2020) - not a fixed formula. Interim maintenance can be sought early, while the main case is pending, so you are not left without support during litigation.

Will I get custody of my children?

No parent has an automatic right; courts decide based on the child's welfare - age, stability, schooling and attachment all matter, and a mother's care of a young child is given real weight though not an automatic presumption. Interim custody can be sought immediately rather than waiting for the final decree.

What should I absolutely avoid doing?

Do not sign any document - especially regarding property, maintenance waiver, or custody - without legal review, even if pressured to 'settle quickly and amicably.' Do not leave without securing your documents and streedhan evidence first if it is safe to gather them. Do not make the dispute public on social media, as it can be used against you.

What if I am pressured or harassed to withdraw or settle unfairly?

Document every instance - messages, calls, witnesses - since this can itself support a cruelty or domestic-violence claim. You are not obligated to accept a settlement that waives your lawful rights to maintenance, streedhan or custody consideration simply because it is offered as the faster option.
