As soon as I file for divorce, who gets the children?

No one 'gets' the children automatically on filing - custody is decided by the court based on the child's welfare, and until then, the existing living arrangement generally continues unless there is an urgent safety concern. An interim custody or visitation application can be filed right away rather than waiting for the final decree.

What should I prepare right now, at the very start?

A factual note on the child's daily routine, school, medical needs, and who has been primarily caring for them; your own income proof; and any evidence of the other parent's conduct that is genuinely relevant to welfare (not just grievances about the marriage itself, which courts distinguish from parenting ability).

Can my spouse take the children and move away?

Not without legal basis, and moving a child's city or school during a pending case is something courts take seriously. If this is threatened, an urgent injunction or status-quo order can be sought before it happens, which is far more effective than trying to reverse it afterward.

Will the child's own wishes matter?

For older children, generally from around age nine upward, courts give real weight to the child's preference, though it is never the sole factor. Younger children's welfare is assessed through other evidence - routine, attachment, and stability.

What is the difference between custody and visitation, practically?

Custody determines where the child primarily lives and who makes major decisions; visitation (or parenting time) sets out when the non-custodial parent sees the child. Courts increasingly favour arrangements that keep both parents meaningfully involved unless there is a specific reason not to.

How fast can an interim custody order be obtained?

This varies by court and urgency, but interim applications are specifically designed to be decided faster than the main case, since a child's day-to-day care cannot wait years. Call or WhatsApp now if a custody issue is urgent - do not wait for the next scheduled hearing date to raise it.
