Is all property automatically split 50-50 in an Indian divorce?

No - India does not have an automatic community-property rule like some countries. Property stays with whoever legally owns it (as per title documents), though the other spouse may have maintenance or compensation claims, and jointly-owned or jointly-purchased property is divided based on contribution and ownership share.

What about property bought entirely in my name during the marriage?

It generally remains yours in terms of title, but your spouse's financial or non-financial contributions (including homemaking) may be relevant to maintenance calculations even if not to ownership itself. This is a frequent area of dispute worth clarifying early.

What should I do with joint accounts and documents right now?

Do not empty joint accounts unilaterally - this can be used against you and may need to be accounted for later. Instead, document the current balances and asset positions clearly as of now, and seek legal advice before moving significant funds.

Is streedhan (gifts/jewellery given to the wife) divided as marital property?

No - streedhan remains the wife's absolute property under settled Supreme Court precedent and is not 'divided'; it is hers to keep or recover if withheld, separate from the general property division or maintenance discussion.

What about a house we're still paying EMI on together?

This needs specific attention - who continues paying, who retains the right to live there, and how the eventual sale or buyout is handled are all separate questions that should be addressed in the settlement or decided by the court, not left ambiguous.

How do I protect my financial position while the case is pending?

Gather and secure copies of all property documents, bank statements, and investment records now, before the case gets contentious. Call or WhatsApp for a free initial consultation to map out what's actually at stake in your specific situation before any asset-related step is taken.
