Is a live-in relationship actually legal in India?

Yes - living together without marriage between consenting adults is not illegal in India. The Supreme Court in S. Khushboo v. Kanniammal (2010) held that living together is a facet of the right to life under Article 21, and it is not a criminal offence, regardless of social disapproval.

Does a live-in relationship get treated like a marriage legally?

Not automatically - Indian law does not give live-in partners the same default rights as married spouses (such as automatic inheritance). However, in Indra Sarma v. V.K.V. Sarma (2013) the Supreme Court set out factors - such as duration, shared household, and public acknowledgment of the relationship - that determine if it qualifies as a 'relationship in the nature of marriage' for specific protections.

Can a live-in partner claim protection under the Domestic Violence Act?

Yes - the Protection of Women from Domestic Violence Act 2005 specifically extends to women in a 'relationship in the nature of marriage,' not only legally married women, allowing claims for protection orders, residence rights, and monetary relief against an abusive partner.

Can a live-in partner claim maintenance if the relationship ends?

In some circumstances, yes - courts have allowed maintenance claims under the Domestic Violence Act and, in certain long-term, marriage-like relationships, under Section 125 CrPC (now Section 144 BNSS) by analogy, though this is more fact-dependent and contested than maintenance for a legally married spouse.

What about children born from a live-in relationship?

Children born from a live-in relationship are legally recognised as legitimate for most purposes, including inheritance rights from their parents, following the Supreme Court's reasoning in cases addressing children's rights independent of their parents' marital status.

What about property bought or shared during the relationship?

Property remains with whoever holds legal title, same as in a marriage - there is no automatic 50-50 claim. If both partners contributed financially to a property held in one partner's name, this can become a genuinely contested issue requiring evidence of actual contribution, best clarified through a written agreement at the time of purchase rather than left to a later dispute.

Should live-in partners have a written agreement?

It is strongly advisable, though not legally mandatory - a cohabitation agreement addressing property, finances and expectations reduces the risk of a bitter, evidence-heavy dispute if the relationship ends, similar in purpose to (though legally distinct from) a prenuptial agreement.

What should I do if I'm facing a dispute in a live-in relationship right now?

Document the relationship's key facts - duration, shared residence, financial contributions, any threats or abuse - and get advice on which specific protection (domestic violence remedy, property claim, or child-related issue) actually applies to your situation.
