My child is pressuring me to transfer my property to them now - what should I consider?

You are not obligated to transfer property during your lifetime, and if you do, you can make it conditional on being cared for - under the Senior Citizens Act, such a conditional transfer can be declared void and even reversed if the condition of care is not honoured.

I already transferred my property, and now I'm not being taken care of - what can I do?

Several High Courts and the Supreme Court have upheld the Maintenance Tribunal's power to declare such a transfer void and direct eviction of the person who received it, where care was the condition and it was not honoured. This is a real, increasingly used remedy, not just a theoretical one.

Can my children force me out of my own house?

Not lawfully. If this is threatened or attempted, a maintenance application before the Tribunal (usually headed by the Sub-Divisional Magistrate) can secure both your right to remain and an order for financial maintenance, and proceedings are meant to conclude within 90 days.

Should I make a will even if I don't expect any dispute?

Yes - the majority of family property disputes after a death happen precisely because there was no will, leaving distribution to default succession law rather than your own wishes. A registered will, ideally with a medical fitness certificate at the time of signing, is the strongest protection against later challenge.

What should I do if I am being pressured to sign documents I don't fully understand?

Do not sign anything under pressure or without understanding it fully - ask for time, and have an independent advocate review it before signing. Message on WhatsApp if you are ever unsure about a document being presented to you.

Who can help me if I can't afford a lawyer right now?

Free legal aid is available through the District Legal Services Authority for eligible senior citizens under the Legal Services Authorities Act, and a free initial consultation can help you understand your options regardless.
